General terms governing wine purchases made via the Mr.Vino Lugano online shop.

Age Verification — Canton Ticino
The sale of wine and any other alcoholic beverage is reserved for persons who have reached the age of 18. In the Canton Ticino, the sale of any alcoholic beverage to minors under 18 is prohibited without exception (Art. 51 of the Cantonal Health Act). By placing an order, the customer confirms that they are at least 18 years old.
1 Scope of Application
These general terms and conditions of sale (hereinafter «Conditions») apply to all orders for products placed via the online Enoteca accessible at mrvino.ch/shop (hereinafter the «Site»), managed by Mr.Vino, a sole proprietorship based in Lugano (hereinafter «Mr.Vino», «we» or «the Seller»).
By placing an order, the customer declares to have read these Conditions and to accept them in full. Any different conditions of the customer do not apply, unless agreed in writing.
Mr.Vino reserves the right to modify these Conditions at any time. The version of the Conditions published on the Site at the time of conclusion of the contract applies to each individual order.

3 Products and Availability
The products offered are selected wines mainly from small producers. Photographs, vintages and descriptions are indicative: as these are natural products, the vintage actually delivered may differ from the one illustrated and small variations in label or organoleptic characteristics are possible.
Offers are valid while stocks last. If a product ordered is not available after confirmation of the order, we will inform the customer and proceed to refund the amount related to the missing product.
4 Prices
All prices are indicated in Swiss Francs (CHF) and include 8.1% VAT. Any shipping costs are indicated separately and added before confirmation of the order, according to the rates in point 7.
The price published on the Site at the time of ordering is binding. We reserve the right to correct manifest price or typing errors even after the order has been sent; in this case the customer will be informed and can cancel the order without charge.
5 Conclusion of Contract
The presentation of products on the Site constitutes an invitation to submit an offer and not a binding offer. The sales contract is perfected when the customer receives the order confirmation from Mr.Vino via e-mail, or at the latest with the shipment of the goods.
The customer receives an order summary before sending and can verify and correct the data entered. The order is sent by clicking the payment button.
6 Payment
Payment takes place online at the time of order via the payment service provider Stripe, which allows payment with major credit and debit cards and supported payment methods (depending on availability: TWINT, Visa, Mastercard and others).
Card data is transmitted in encrypted form directly to Stripe: Mr.Vino does not have access to nor does it store complete payment card data. The charge occurs at the time of order confirmation.
7 Delivery, Pickup and Shipping Costs
Delivery normally takes place within Swiss territory. The times indicated are estimates and non-binding; any delays do not give the right to cancellations or compensation unless provided by mandatory law.
7.1 — Pickup at the Enoteca
The customer can choose free pickup at our Enoteca in Via Carlo Maderno 23 in Lugano. You will receive a notification when the order is ready and you can pick it up during our opening hours, without any shipping costs.
7.2 — Home Delivery
For home deliveries we apply a fixed rate of CHF 19.90 for orders with a value of less than CHF 150.—. For orders equal to or greater than CHF 150.—, home delivery is free. Applicable shipping costs are always shown transparently in the cart before order confirmation.

At pickup and delivery, an identity document may be requested for age verification (see point 9). The risk of deterioration or loss of the goods passes to the customer at the time of delivery, or respectively when made available for pickup.
8 Returns, Damaged Bottles and Defective Wines
Wine is a foodstuff and a natural product. For this reason we treat every report with the utmost care, distinguishing between the different situations that may arise. In all cases our priority is to find a fair solution quickly: replacement of the bottle, credit note or refund.
8.1 — Right of Reconsideration
Swiss law does not provide for a general right of withdrawal for the consumer in online sales comparable to the European one. Furthermore, as it is a foodstuff, wine regularly delivered and conforming to the order cannot be returned for simple reconsideration, nor can an already opened bottle be returned, except in the case of a defect described in the following points. The warranty rights provided by law (Art. 197 et seq. CO) remain unaffected.
8.2 — Bottles Arrived Broken or Damaged in Transit
We invite you to check the package upon delivery. If a bottle is broken, leaking or visibly damaged:
- notify us within 48 hours of delivery by writing to info@mrvino.ch;
- indicate the order number and attach some photographs of the package and the damaged bottle (they also help us improve packaging and act against the courier);
- keep the bottle and packaging until the case is resolved.
Once the report is verified, we proceed to replace the bottle or refund its amount, without additional costs to you.
8.3 — Defective Wine («corked», oxidation and other defects)
It can happen, with any winery and any producer, that a single bottle presents a defect independent of our storage. The most frequent case is the so-called «corked» wine (TCA contamination), which gives the wine scents of wet cardboard or mold; anomalous oxidation or unwanted refermentations can also occur. These are recognized defects in the wine world and we handle them as follows:
- contact us within 14 days of delivery at info@mrvino.ch, indicating the order number and describing the defect found;
- the bottle must be mostly full: open and taste it, but do not empty it. We ask you to keep the bottle with the cork and the remaining wine so we can evaluate the defect together (if possible, keep the bottle in a cool place);
- we may ask you for some information or photographs and, in case of doubt, to return the bottle.
Once the defect is recognized, we offer you at your choice the replacement with the same label (if available), a bottle of equal value or a refund. This policy concerns wine defects: it does not cover the case where the wine is simply different from your personal tastes or the vintage delivered differs from the one illustrated in the catalog (cf. point 3).
8.4 — Incorrect or Incomplete Order
If you received a product different from the one ordered, or your order is incomplete, notify us within 48 hours of delivery: we will proceed to send you the correct or missing product, or to refund the difference.
8.5 — Refunds
Refunds are made using the same payment method used for the order, via Stripe, normally within 14 days of acceptance of the report. We do not apply handling costs for accepted cases.
In summary
Broken bottle or incorrect order: write to us within 48 hours with photos. Wine that is «corked» or defective: write to us within 14 days keeping the bottle with the remaining wine. In both cases we resolve with replacement, credit note or refund.
9 Age Verification and Protection of Minors
The sale of alcoholic beverages is reserved for adults. In the Canton Ticino the minimum age for purchasing any alcoholic beverage, including wine, is 18 years old (Art. 51 of the Cantonal Health Act; Art. 136 of the Swiss Criminal Code for the protection of minors).
By placing an order, the customer declares and guarantees to be 18 years of age. Mr.Vino reserves the right to:
- request the presentation of a valid identity document at the time of delivery or pickup;
- refuse delivery if there are doubts about age or if the minimum age cannot be verified;
- cancel the order in case of untrue statements.
The delivery of alcoholic beverages to minors is prohibited. It is also prohibited to order alcoholic beverages on behalf of minors.
10 Warranty for Defects
The provisions on warranty for defects of the item sold provided by the Swiss Code of Obligations (Art. 197 et seq. CO) apply. The customer is obliged to check the goods upon delivery and to report recognizable defects without delay.
11 Liability
Mr.Vino is liable according to legal provisions. Within the limits permitted by mandatory law, any liability for indirect damages, loss of profit or damages resulting from irresponsible consumption of products is excluded. Nothing in these Conditions limits liability in case of intent or gross negligence, nor liability for damage to life and health.
Wine should be consumed in moderation. The consumption of alcohol can harm health.
12 Data Protection
The processing of the customer's personal data is described in our Data Protection Policy (Privacy Policy), which forms an integral part of these Conditions.
13 Applicable Law and Jurisdiction
These Conditions and any contractual relationship between the customer and Mr.Vino are governed exclusively by Swiss law, with the exclusion of conflict of law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For any dispute, the jurisdiction of the seat of Mr.Vino in Lugano is competent, subject to the mandatory jurisdictions provided by law for the protection of the consumer.
14 Severability Clause
Should any provision of these Conditions prove to be null or void, this does not affect the validity of the remaining provisions. The null provision shall be replaced by a valid rule that comes as close as possible to the economic objective pursued.
